Re: Parks and Mailboxes
Dear Residents of Texas Grand Ranch,
We want to thank everyone for their questions and comments on the Mailboxes and TGR Parks
turned over from Patten. To be transparent, we want to address Lonestar Park and the Dipping
Vat / Lonestar Mailboxes.
Background:
Patton started the Lonestar Park Project in August 2022, with a completion deadline in April
2023. Unfortunately, Patton did not meet the deadline for reasons unknown to the Board. Since
Lonestar Park was a Patton-led initiative, there was no written requirement or agreement for
Patton to complete this park before their exit from TGR. After months of discussions with Patton,
the Board required Patton to complete the park to a minimum standard; however, this did not
include "upgrades" that Patton may have previously discussed (e.g., playground equipment,
parking, etc).
Patton also launched the Lonestar / Dipping Vat Mailbox Project with the Huntsville Post Office
in 2022 - to reallocate residents into new mailboxes by early 2023. These projects would
provide enough space for all future residents to have a mailbox. Patten completed the recent
mailbox locations to a different standard than the Texas Grand Ranch Circle location.
During the turnover, the Board also addressed the incomplete covers at the TGR Circle
Mailboxes. Patten indicated their unwillingness to do further work on those covers and would
not cover the remaining boxes.
Current State:
We want to address the community's concerns that The Board accepted incomplete projects
from Patten. The Board pushed back on Patten, we consulted with our legal counsel and
management company on how to proceed, and there was no avenue available to us when
Patten pulled out of the projects.
Additionally, the Board sought counsel on whether we should pursue legal action against Patten
for the way the community was left. The answer was absolutely not. Patten is a corporation
with significant financial backing. Pursuing legal action opens the community up to
insurmountable financial obligations to fight a battle and potentially receive nothing in return or
be stuck paying legal fees for both parties in the event of a loss. As we understand it, Patten
had no formal obligation to complete the park and mailboxes to our satisfaction before they
turned the community over to a homeowner-run POA.
As you may know, Patton left TGR with $2.7 million at transition, a robust financial position
typically unheard of in communities transitioning from a developer.
At the upcoming Open Board Meeting on September 28, 2023, at 6:00 PM, the Board will be
providing updates and recommendations on how we will move to bring these projects up to our
community standards.
